Thank you for trusting us to accompany you on this adventure. We know a journey begins the moment you decide to plan it. That's why, beyond arranging bookings, we want you to feel informed, protected, and supported.

This document contains the terms and conditions for your travel experience. Please take a few minutes to read it carefully. Here you'll find everything you need to ensure things flow as you expect: how bookings work, the responsibilities each party assumes, and how to handle changes, unexpected events, or special needs.

Introduction and Legal Framework

LATINAMERICAN TOURS, a travel agency registered with the Ministry of Commerce, Industry and Tourism (RNT No. 30393), acts as an intermediary in organizing tourist services (tours, hotels, transportation, excursions, cruises, etc.) in accordance with Law 300 of 1996, Decree 053 of 2002, and Law 1480 of 2011.

Under no circumstances do we act as the direct provider of those services, so we assume no liability for their quality or execution beyond our coordination role. Our responsibility is limited to a reasonable-efforts obligation, diligently managing according to the conditions informed by the suppliers.

We will only be liable in case of proven direct negligence in our intermediation, without prejudice to the obligations of the contracted suppliers.

In situations of force majeure, fortuitous events, or circumstances beyond our control, LATINAMERICAN TOURS is exempt from liability. For more details, see Section 14: Force Majeure and Extraordinary Events.

Quotes

  • All quotes issued by LATINAMERICAN TOURS are informational and do not constitute a reservation or guarantee availability.
  • Quotes remain valid for 12 hours from issuance, unless otherwise expressly stated.
  • Rates shown in quotes are subject to confirmation by the supplier at the time of booking.

Reservations

  • Reservations are only considered valid once confirmed in writing and the corresponding deposit has been made.
  • To make a reservation, you must submit in writing (email or digital form) the following information for each traveler:
    • Full name as shown on the ID document or passport
    • ID or passport number
    • Date of birth
    • A clear scanned copy or photo of the original document (national ID for domestic travel or valid passport for international travel)
  • LATINAMERICAN TOURS is not responsible for errors in information provided by the passenger or issues arising from incorrect or incomplete data.
  • For claims, LATINAMERICAN TOURS will only respond to requests made in writing (email or official forms), in accordance with commercial traceability regulations.

Rates

  • All rates are subject to change without prior notice, based on supplier availability and policies.
  • If there is a rate adjustment after a deposit has been made, the passenger will be informed before final payment and may accept the change or cancel without penalty if the adjustment exceeds 10% of the original total.

Air and Maritime Transportation

LATINAMERICAN TOURS acts as an intermediary between the passenger and airlines or cruise lines, and therefore is not responsible for operational changes, delays, cancellations, rescheduling, fare variations, or any other modifications beyond our control. However, we will assist you in managing those situations with the appropriate provider under the contracted service conditions.

Hotel Services

LATINAMERICAN TOURS arranges hotel bookings according to the passenger's requests. Specific room assignments, extra beds, connecting rooms, early check-in or late check-out are subject to hotel confirmation and internal policies. In case of dissatisfaction, the agency may assist in lodging a claim with the provider but will not be liable for conditions not expressly guaranteed at the time of booking confirmation.

Transfers

In case of no-show at the agreed time and location, the service is considered rendered and no refund will be issued. Passengers must immediately inform the local service operator of any flight changes, delays, or cancellations.

Documentation

It is the passenger's sole responsibility to have all required travel documents (valid passport, visas, notarized permits, vaccination certificates, tickets, vouchers, etc.). LATINAMERICAN TOURS provides general guidance but does not guarantee the accuracy or validity of those requirements.

Modifications, Cancellations and Right of Withdrawal

All change or cancellation requests must be submitted in writing and are subject to the specific policies of the involved providers. Initial deposits are non-refundable. Once the trip has begun, partial or voluntary non-use of services does not entitle you to a refund, unless the provider authorizes it.

Right of Withdrawal (Law 1480/2011)

Applies only to non-face-to-face purchases within five (5) business days of purchase, provided the service has not begun and no tickets or vouchers have been issued.

Personal Belongings

LATINAMERICAN TOURS is not responsible for loss, damage, theft, or misplacement of personal items. Passengers are solely responsible for their belongings and are advised to obtain insurance covering such risks.

Recommendations and Optional Coverages

We strongly recommend purchasing medical assistance and trip cancellation insurance that includes coverage for accidents, illness, force majeure cancellations, and other unforeseen events. For cruises, additional cancellation insurance is suggested due to strict carrier policies.

⚖️ We categorically reject any form of sexual exploitation of minors (Laws 679/2001 and 1336/2009).

Purchases through Third Parties

We are not liable for services purchased via unofficial channels, intermediaries, or external platforms not directly related to LATINAMERICAN TOURS.

Force Majeure and Extraordinary Events

LATINAMERICAN TOURS and its suppliers are exempt from liability for events beyond their control (natural disasters, pandemics, strikes, government decisions, airport closures, extreme weather, civil unrest). If the itinerary is affected, we will offer reasonable alternatives such as rescheduling, changing destinations, credit notes, or partial refunds.

General Liability Clauses

LATINAMERICAN TOURS (RNT 30393) acts purely as an intermediary of tourist services. We assume no liability for accidents, baggage loss, or passenger misconduct. For penalty details, see Section 10.

Final Provisions

🔒 Data Protection: In compliance with Law 1581/2012 and Decree 1377/2013, you authorize the processing of your personal data for logistical, commercial, and administrative purposes. You may exercise your rights to access, rectify, delete, or complain at any time.

⚖️ Dispute Resolution and Jurisdiction: Any dispute will first be attempted by mutual conciliation; otherwise, the courts of Medellín, Colombia shall have jurisdiction.

✅ Acceptance: Your acceptance—by handwritten or digital signature, email submission, or checking the consent box—constitutes valid proof of informed consent under Law 527/1999.

🔄 Updates: We reserve the right to update these terms at any time; changes will apply to new bookings upon publication.
